Policies Terms of Service Privacy Policy Acceptable Use Refund Policy

These Terms govern access to and use of IDCS Atlas websites, virtual private servers, network resources, support, and related services. By placing an order or using a service, you agree to these Terms and the policies incorporated by reference.

1. Service provider

In these Terms, “IDCS Atlas”, “we”, “us”, and “our” refer to the IDCS Atlas platform operating from 16 Nanyang Dr, Singapore 637458. “Customer”, “you”, and “your” refer to the person or organisation ordering or using the Services.

2. Eligibility and authority

You must be legally capable of entering into a binding contract. If you use the Services for an organisation, you confirm that you have authority to bind that organisation. You must provide accurate account, billing, and contact information and keep it current.

3. Orders and service activation

An order is subject to acceptance, payment verification, capacity, sanctions screening, fraud prevention, and technical feasibility. Product specifications, regions, prices, and estimated activation times shown at checkout form part of the order. We may reject or request additional verification for an order where reasonably necessary.

IP addresses and other network identifiers are licensed for use with the Services and are not transferred to you. They may change when reasonably required for security, routing, compliance, or operational reasons.

4. Accounts and security

  • You are responsible for activity performed through your account, credentials, API keys, and servers.
  • You must use reasonable security measures, including strong passwords, current software, and restricted administrative access.
  • You must notify us promptly at [email protected] if credentials or systems may have been compromised.
  • You may not share an account in a way that prevents us from identifying the responsible customer.

5. Fees, billing, and taxes

Fees are shown in the currency stated at checkout. Unless otherwise stated, recurring Services renew for successive billing periods until cancelled. You authorise us and our payment providers to collect charges due under your order. You are responsible for applicable taxes, duties, and bank or payment-provider charges, except taxes imposed on our income.

Overdue accounts may be restricted or suspended after reasonable notice, except where immediate action is necessary to prevent fraud, abuse, or security harm. Refunds and billing adjustments are governed by our Refund Policy.

6. Acceptable use

You must comply with our Acceptable Use Policy, applicable laws, and third-party rights. You are responsible for customer content and for ensuring that your applications, users, and traffic comply with those requirements.

7. Customer content and backups

You retain ownership of content you place on the Services. You grant us a limited right to host, transmit, copy, and process that content only as needed to provide, secure, support, and comply with law in relation to the Services.

Unless a specific backup service is included in your order, you are responsible for maintaining independent and restorable backups. Snapshots or provider backups are not a substitute for an independent backup strategy.

8. Suspension and termination

We may restrict, suspend, or terminate Services where reasonably necessary to address a material breach, non-payment, security threat, unlawful activity, network abuse, sanctions requirement, or risk to other customers or infrastructure. Where practicable, we will provide notice and an opportunity to remedy the issue. Immediate action may be taken when delay could cause harm or create legal exposure.

You may cancel recurring Services through the available account or support channel. Cancellation normally takes effect at the end of the paid billing period unless stated otherwise. After termination, content may be deleted and may not be recoverable. You should export required data before cancellation.

9. Service availability and changes

We aim to operate reliable Services but do not promise uninterrupted or error-free operation unless a separate service level agreement expressly applies. Maintenance, upstream providers, internet conditions, security incidents, and events outside reasonable control may affect availability. We may make reasonable technical or operational changes while seeking to preserve the material functionality of an active paid Service.

10. Warranties and disclaimers

To the extent permitted by law, the Services are provided on an “as available” basis. We do not guarantee that a particular workload will meet your performance, compliance, or business requirements. You are responsible for evaluating whether the Services are suitable for your intended use.

Nothing in these Terms excludes a warranty, right, or remedy that cannot lawfully be excluded.

11. Limitation of liability

To the maximum extent permitted by law, neither party is liable to the other for indirect, incidental, special, exemplary, or consequential loss, or for loss of profit, revenue, goodwill, opportunity, or data, arising from the Services.

Our total aggregate liability arising from a Service is limited to the amount you paid for that affected Service during the three months immediately preceding the event giving rise to the claim. This limitation does not apply to liability that cannot lawfully be limited, including liability for fraud, wilful misconduct, or death or personal injury caused by negligence where applicable.

12. Governing law and disputes

These Terms are governed by the laws of Singapore, without regard to conflict-of-law rules. The courts of Singapore have non-exclusive jurisdiction. If you are a consumer, this section does not remove mandatory rights or forums available to you under applicable consumer law.

Before commencing formal proceedings, each party should make a good-faith effort to resolve the dispute by written notice describing the issue and requested resolution.

13. Changes to these Terms

We may update these Terms to reflect legal, security, operational, or service changes. We will publish the revised version and update the date above. If a change materially reduces your rights during a paid term, we will provide reasonable notice where practicable.
